Terms of Service

These terms govern your use of Chat Cactus — the platform, dashboard, APIs, chat widget, and channel integrations (the "Service"). By creating an account or using the Service you agree to them. If you use Chat Cactus on behalf of a company, you represent that you can bind that company.
1. The service
Chat Cactus lets you build AI agents, train them on your documents, and deploy them across channels (website widget, voice, email, SMS, phone calls, WhatsApp, Telegram, Slack, Discord, Messenger, and custom webhooks). Features vary by plan. We may improve, add, or retire features over time.
2. Your account
Keep your credentials confidential; you are responsible for activity under your account and workspaces. Provide accurate information and keep it current. You must be at least 16 years old.
3. Your content and your end users
You retain ownership of everything you upload — prompts, documents, branding — and the conversations your agents generate. You grant us the limited rights needed to operate the Service (store, process, transmit to AI model and channel providers, display back to you).
You are responsible for what your agents collect from and say to your end users: obtain any required consents (e.g. for lead capture or phone-call handling), honor opt-outs, provide your own privacy notice, and don't deploy agents for advice that requires a licensed professional without appropriate safeguards.
4. Acceptable use
You agree not to use the Service to:
- send spam or unsolicited messages, or violate the policies of connected channels (Twilio, Meta, Slack, Discord, Telegram, Google);
- upload content that is illegal, infringing, or that you lack rights to use;
- impersonate others, mislead end users into believing they are talking to a human where disclosure is required, or collect data unlawfully;
- probe, overload, or interfere with the Service, or circumvent plan limits, trials, or security controls;
- build a competing dataset by systematically extracting model outputs.
We may suspend or terminate accounts that violate these rules.
5. AI output disclaimer
Agent replies are generated by third-party AI models and can be inaccurate, incomplete, or inappropriate despite the guardrails you configure. You are responsible for reviewing how your agents behave and for any decisions made in reliance on their output. The Service is not a source of legal, medical, or financial advice.
6. Plans, trials, and billing
Paid subscriptions are billed monthly through Stripe. Where a free trial is offered, your card is collected at checkout and first charged when the trial ends; each workspace gets one free-trial allowance in total (unused trial days carry over if you cancel and resubscribe, but the allowance does not reset). Prices are shown at checkout; existing subscribers keep their signup price until they change plans. Coupon codes are applied on the payment page and governed by their stated terms.
You can cancel anytime from Manage billing. Cancellation takes effect immediately: your workspace returns to the free tier and published agents are taken offline (their configuration is preserved). Fees already paid are non-refundable except where required by law. Usage-based safeguards (message quotas, AI cost caps) apply per plan; we may throttle or downgrade model usage when a cap is reached.
7. Third-party services
Channel integrations depend on third parties (Twilio, Google, Meta, Slack, Discord, Telegram) and their terms apply to your use of those channels. Their outages, policy changes, or API changes are outside our control. You are responsible for fees charged by providers you connect with your own accounts (e.g. Twilio numbers and call minutes).
8. Intellectual property
We own the Service — its software, design, and branding. These terms grant you no rights to them other than the right to use the Service. Feedback you send us may be used without obligation.
9. Warranty disclaimer and liability
The Service is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. To the maximum extent permitted by law, our total liability for any claims arising out of the Service is limited to the amounts you paid us in the twelve months before the claim, and we are not liable for indirect, incidental, or consequential damages, or for lost profits, data, or goodwill.
10. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate the Service for breach of these terms, unlawful use, or non-payment, with notice where practicable. On termination, your right to use the Service ends and data is handled per the Privacy Policy's retention terms.
11. Changes to these terms
We may update these terms; the date above reflects the latest version. Material changes will be announced to account owners by email, and continued use after the effective date constitutes acceptance.
